Terms and Conditions of Service for Birkin Blinds Pty Ltd

1. Acceptance of Terms: By paying the 50% deposit, you ("the Customer") agree to the terms and conditions outlined herein. These terms constitute a legally binding agreement between you and Birkin Blinds Pty Ltd ("the Company").

2. Deposit Requirement: To confirm a job, a 50% deposit of the total quoted amount is required. This deposit is non-refundable.

3. Final Payment: The remaining balance of the total quoted amount is required prior to installation. Final balance must be paid to confirm installation date. When installing multiple items in phases, the balance of desired items must be paid prior to installation of each phase. 

4. Turnaround Times: Standard turnaround times are as follows:

   • Roller Blinds & Curtains: 2-3 weeks

   • Venetian Blinds, Vertical Blinds & Outdoor Blinds: 5 weeks

   • China-made Plantation Shutters: 8 weeks

   • Australian-made Plantation Shutters: 2 weeks

   • Please note that special orders or certain colours/fabrics may require additional time. The Company will communicate any delays promptly.

5. Drilling Policy: Unless otherwise specified, Birkin Blinds does not drill into steel or stone surfaces.

6. Confirmation of Quote: Payment of the deposit serves as confirmation that the Customer has reviewed and accepted the provided quote and terms and conditions.

7. Installation: The Company will schedule the installation date when products are ready and final balance has been paid in full for the desired items to be installed. The Customer must ensure access to the installation area and clear any obstacles that may hinder the installation process.

8. Cancellation Policy: Cancellation of the order after payment of the deposit may result in forfeiture of the deposit unless otherwise agreed upon by both parties.

9. Changes and Amendments: Any changes or amendments to the order must be communicated to the Company in writing and may result in adjustments to the total quoted amount and/or turnaround times.

10. Liability: The Company shall not be liable for any damages or losses resulting from improper use, installation by third parties, or force majeure events beyond its control.

11. Governing Law: These terms and conditions shall be governed by the laws of New South Wales, Australia, and any disputes shall be resolved in the appropriate courts of Sydney, NSW.

12. Severability: If any provision of these terms and conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Late Fees & Legal Fees: Should the final balance be delayed, a late fee of 10% a day can be charged to the Customer at the Company's discretion. All Legal Fees, Collection Fees and Late Fees will be forward to the Customer if payment is not made on time.
